(ii) any obscene, indecent, inflammatory, pornographic, illegal, unlawful, defamatory, harassing, threatening, menacing, offensive or otherwise inappropriate material; and/or
(iii) any viruses, worms, defects, Trojan horses or similar disabling or malicious code;
(c) engage in any illegal, unlawful or fraudulent conduct, and without limitation, you must not:
(i) make fraudulent enquiries and/or requests through our website;
(ii) use another person’s details without their permission or impersonate another person when using our website;
(iii) create accounts by automated means or under false or fraudulent pretences; and/or
(iv) use the website to violate the security of any computer or other network;
(d) tamper with or hinder the operation of our website;
(e) use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the website;
(f) copy or translate for commercial use, reproduce, adapt, vary or modify any material in this website without the prior written consent of

(g) modify, vary modify, adapt, translate or reverse engineer any portion of the website.
3.1 All content on our website are provided on an “as is” basis and may contain errors or omissions (including typographical errors). We do not provide any warranty or guarantee as to the:
(a) completeness or accuracy of information on our website; and
(b) suitability of the website or any product and/or service referred to on our website for your purpose.
3.2 To the full extent permitted by law:

3.3 You agree that if we are liable to you, and are unable to exclude such liability, our liability to you for any loss or damage will be reduced to the extent (if any) that you cause or contribute to the loss or damage.

If any products and/or services are displayed on our website, we reserve the right to discontinue or change the products and/or services, their prices, colours, specifications and any other details about them at any time without notice.

4.1 Our website may contain links to third party websites. We make no representations or warranties about these third parties or the content of their websites, and have no responsibility or liability for those third-party websites or the acts and omissions of those third parties.
4.2 The links to third party websites do not indicate, expressly or impliedly, that we endorse the third party’s website, and/or any products and/or services displayed on them.
5. Intellectual Property Rights
5.1 All content on our website is protected by copyright and other intellectual property rights.
5.2 You must not adapt, reproduce, broadcast, decompile, distribute, copy, store, transmit, publish, display, use, exploit or create derivative works from any part of our website, or commercialise any content on our website without our prior written consent.
6.1 We may at any time, with or without notice, terminate, suspend or limit your access and use of our website and (where relevant) any account you open on our website, if:
(a) you breach any of these terms and either the breach cannot be remedied or you fail to remedy the breach within 14 days of the date of your breach (whether or not we give you notice of your breach in such cases);
(b) any event or situation occurs beyond our reasonable control; and/or
(c) there are legitimate business or commercial reasons.

Delivery Charges and Service
For your convenience, Festoon Lighting Perth offers the following delivery options:
- Home Delivery
You will be able to choose your preferred method during the checkout process. Whether you choose delivery or collect, your order will be fulfilled by our Balcatta Head Office. Orders will be processed within 72 hours. If there is a problem fulfilling your order (e.g. items need to be ordered in), we will call you within this period to let you know.
All orders are delivered by courier.
Your delivery cost will be displayed at checkout, before you complete your order, and is charged to your credit card upon submitting your order.
To the extent permitted by law, Festoon Lighting Perth does not accept any liability whatsoever for the goods ordered and/or any loss or damage incurred by any person in relation to your order once it has been received by the courier for delivery to you.
We suggest that you have your order delivered to an address where someone will be present during business hours to sign for the delivery. If the delivery address is unattended, our couriers are authorised to leave the goods at that address. Orders cannot be delivered to post office boxes or postal lockers.
If you are having your order delivered, you can pay online using your credit card.
Once your order has been shipped, you will be advised via email. Delivery could take 7-10 working days from this date. After this time if you have not received your order, please email us at email@example.com
Online shopping is only available to customers within Australia, however we do welcome product enquires from overseas. If you are enquiring from overseas please contact our team via email on firstname.lastname@example.org and we will investigate and advise the possibility of supply.
You can pick up your order from Festoon Lighting Perth free of charge, with no minimum spend.
Once your order is processed we will contact you when your order is ready to be collected. If there is a problem fulfilling your order (e.g. items need to be ordered in), we will contact you within 72 hours to let you know.
If you nominate to place an order online and choose to pick up in store, you or your nominated person will be required to provide identification (of which a copy will be taken) for the purposes of order verification and store security practices.
Returns & WarrantiesRETURNS
Festoon Lighting Perth offers a full refund or exchange for website sales for change of mind purchases within a 30-day period with proof of purchase (receipt or website order confirmation email).
Should your goods be faulty or damaged upon receipt, Festoon Lighting Perth will offer a full refund or exchange in accordance with its obligations under the Competition and Consumer Act 2010 (Cth) (“Act”).
To the extent permitted by law, Festoon Lighting Perth:
- limits its obligations and liability for the repair, replacement or refund of the purchase price of any goods to its obligations under the Act;
- is not liable for any contingent, consequential or punitive damages arising in way whatsoever in relation to the use of any goods; and
- is not liable for any claim, loss or expense incurred by any person resulting from the delivery, non-delivery or return of any goods.
- Products that have been installed cannot be returned for a change of mind refund/exchange.
- Products may differ from those pictured on the website due to natural variations in colour/finish and scale of the image.
You have three options for returning your goods.
1. Returns of purchases made online
To receive an immediate exchange or refund, you can return the goods within 30 days to Festoon Lighting Perth’s Head Office. A refund or exchange will be made at the same value as the original purchase price, excluding freight if you had your order home delivered. You must present a copy of your store receipt or website order confirmation email.
All goods must be returned in original packaging, in a resalable condition and have not been installed.
2. Return by shipping
To arrange a refund or exchange by sending the goods back to Beacon Lighting, please email our online sales support team on email@example.com or call 08 9240 4939 (Mon-Fri, 9.00am-5.00pm AWST).
You will need to cover the cost of the freight, and include your original receipt or website order confirmation email with your returned items. All goods must be returned in original packaging, in a resalable condition and not been installed.
Shipped returns may take up to 14 days to process, and notification will be by email.
Festoon Lighting Perth offers a twelve (12) month warranty on all Festoon lighting purchased directly through Festoon Lighting Perth and installed by a qualified electrician. This does not include globes, damage caused by negligence (at the discretion of Festoon Lighting Perth) or on sold Lighting chain.

Festoon Lighting Perth is a retailer, which trades utilising the web through its website.
Collection of personal information
Festoon Lighting Perth does not collect personal information unless it is necessary for us to carry out our functions and activities as a retailer. We only collect such information by lawful and fair means and in an unobtrusive way. You may provide us with personal information about yourself or others each time you contact us by phone, fax, letter or email. We will in such circumstances only use the personal information provided for the sole purpose of providing the service you have requested.
